The Temporary Foreign Worker Program has been substantially amended recently. What are the major changes?

The regulatory changes made to the Temporary Foreign Worker Program (TFWP) came into force on April 1, 2011. The highlights of the changes are:

  • All employment offers will be subject to a new Genuineness assessment;
  • Employers who have hired foreign workers will be subject to a Substantially the Same assessment in order to renew employment with the foreign workers or recruit new foreign workers. Employers who fail to meet their commitments to workers with respect to wages, working conditions and occupation will be subject to a two-year ineligibility;
  • A limit is placed on the length of time a foreign worker may work in Canada. With some exceptions, officers may refuse to issue a work permit if a foreign worker has worked in Canada for more than 4 years.
